Guarantees that Vivon will, at our option, replace or repair purchaser’s product if it is defective due to faulty workmanship or materials, subject to the limitations described in this warranty. This warranty does not include a normal increase in softness of the memory foam which does not affect the pressure-relieving qualities of the product. This warranty covers any physical flaw in the product that causes the material to split or crack despite normal usage and proper handling; and deterioration of the cell-structure of the material that causes the product to not return to its original shape. Vivon guarantees the original purchaser of this Vivon mattress that Vivon will, at its discretion, replace or repair this product if it is shown to be defective due to unsound craftsmanship or faulty construction subject to the restraints described in this warranty.

For a period of ten years from the original purchase date of this Vivon mattress, the original purchaser will not be charged by Vivon for the repair or replacement of the product if the product is deemed defective. However, all transportation costs associated with the repair or replacement of this product is the sole responsibility of the original purchaser.

For the duration of years eleven through twenty of this warranty, Vivon will, at its discretion, repair this Vivon mattress for a handling cost to the original purchaser of this product, or replace this Vivon mattress for a prorated cost to the original purchaser plus all transportation costs. Should Vivon, in exercising its sole discretion, choose to replace this Vivon mattress, the cost to the original purchaser shall be prorated as such:

This warranty, provided to the original purchaser of this Vivon mattress by Vivon shall cover degeneration that causes this product to have a visible indentation greater than one and one-half inches (1.5″) that is not the result of a faulty foundation or adjustable base; and any physical imperfection that causes the Vivon materials to split or crack, despite normal usage and proper handling.

This warranty, provided to the original purchaser of this Vivon mattress by Vivon, shall not cover the natural softening of foam that may cause this product to have an indentation less than one and one-half inches (1.5″); nor shall it cover this product if there are visible stains of any kind upon inspection; nor shall it warrant the comfort and/or the personal preference of the original purchaser.

This Vivon mattress is designed to work on a firm, solid surface; a non-spring foundation or an adjustable bed base. This warranty is based upon tests conducted on “sets” that consist of a Vivon mattress and foundations like those described in the previous sentence. Therefore Vivon may request that the original purchaser provide proof of the quality of the foundation.

The cover for this Vivon mattress is warranted for a period of two years from the date of purchase against faults in materials of craftsmanship. Stains of any variety to the cover of this product shall render this warranty void.

The Consumer Product Safety Commission has created the Standard for Flammability of Mattress Sets in Federal Register 16 CFR Part 1633. The foundation used with this Vivon mattress by the original purchaser, unless specified for use as the particular foundation for this Vivon mattress, should not be understood as 16 CFR Part 1633 compliant.

Physical abuse of any variety to this product, whether intended or not, shall render this warranty void. Vivon will reserve the right to deem damages as abuse using its sole discretion.

This warranty is valid only for the original purchaser of this Vivon mattress. An original purchaser is one who purchases the product directly from Vivon.com or an authorized retailer of Vivon Products. If this product is resold, under any circumstance, the product is sold “as-is” and “with all faults.” Proof of Purchase may be required to verify that claimant is the original purchaser of this product and, therefore, eligible to make a valid claim under this warranty.
